The job active law
On November 9, 2001, the Bundestag passed the government-initiated Job Active Act, which the Federal Council also approved on November 30. It is geared towards new ways of implementing employment promotion. The law comes into force on January 1, 2002.
In its original spelling, AQTIV stands for activate, qualify, train, invest and mediate. Unemployment should be prevented before it occurs. On the other hand, the unemployed should be returned to employment as quickly as possible.
The law provides for the following main objectives:
- Long-term unemployment should be avoided and job placement tailored to the needs of the people.
- In future, an individual integration agreement will be made between the unemployed and the employment office when they are registered as unemployed. For the individual case, measures of training and further education are determined.
- With job rotation, the further training of employees and their substitution by the unemployed is linked. This should serve the qualification and reintegration of older and unskilled workers.
- Integration grants are intended to promote the faster return of the unemployed to the primary labor market without causing large deadweight or displacement effects.
- Job creation measures (ABM) and structural adjustment measures (SAM) remain important instruments of labor market policy. The placement of unemployed people from qualification and employment measures in the primary labor market is rewarded for the providers. In eastern Germany in particular, ABM should be more closely linked to the expansion of the infrastructure.
- Periods of maternity leave and childcare are better covered by contributions to unemployment insurance.
- Temporary work is becoming more flexible. As of the new year, a temporary worker can be loaned to a company for a maximum of 24 months instead of the previous twelve.From the 13th month onwards, however, the wage conditions of the hiring company apply to the employee.
Cooperation of the unemployed is required
The new placement concept calls for the active participation of job seekers. The unemployed person's professional strengths and alternatives should be examined at an early stage. This is intended to achieve permanent integration into the labor market.
If the unemployed person does not fulfill his duties and agreed activities, this has consequences. Anyone who does not accept offers for qualifications or a job for no good reason must expect unemployment benefits or unemployment benefits to be canceled for twelve weeks.
The employment office is entitled to check the efforts of job seekers more intensely and earlier than before. There should be a total of 3,000 more intermediaries.
Opposition is not convinced
The Union-governed countries criticized the law as completely inadequate.There are some good approaches, but it is not very suitable for reducing unemployment. Above all, the amalgamation of social assistance and unemployment assistance is missed.
The unemployment association in Germany primarily complains about the financial inadequacy. For the return of workers from the second to the first labor market, significantly higher funds must be raised in order to bring about a real turnaround.
